"Legally" they can do whatever they want and can enforce. Constitutionally they can not restrict gun access to the People.
I agree that "Constitutionally" they cannot, but both the Heller vs DC decision and the McDonald vs Chicago decision by the SCOTUS have stated that their interpretation of the 2nd Amendment is that the federal government can apply "reasonable restrictions" without violating the Constitution.
"Reasonable" is not defined, so I imagine that will be a court battle for another day. That court battle will only be fought after We The People have had enough of the reasonable restrictions handed down.
An administration that will set up an operation allowing guns to go into Mexico for later recovery to be used as a political tool for the case of more gun control on the American Citizenry, will not be bashful about using the SCOTUS decision of "reasonable restrictions" to further their gun control agenda. If Obama is reelected, we will see more open attacks on gun control. If he is not reelected, we will need to be more vigilant for the sneak attack gun control. There are no political elitists, REPUB or DEM, that like the idea of a well armed citizenry. it is counter productive to their goal.
